PUBLICATION OF THE RESOLUTION OF THE 8TH OF SEPTEMBER, 2014, BY THE DIRECTORATE GENERAL FOR ENERGY POLICY AND MINES, BY WHICH THE PROCEDURE OF SUBMISSION OF THE ENERGY SALES INFORMATION BY THE OBLIGATED SUBJECTS OF THE ENERGY EFFICIENCY OBLIGATIONS SYSTEM IS DETERMINED, IN ACCORDANCE WITH THE ROYAL DECREE-LAW 8/2014, OF THE 4TH OF JULY, ON APPROVAL OF EMERGENCY MEASURES FOR GROWTH, COMPETITIVENESS AND EFFICIENCY
On the 11th of September, 2014, in the “Boletín Oficial del Estado” nº 221 it was published the Resolution of the 8th of September, 2014, by the Directorate General for Energy Policy and Mines, by which the procedure of submission of the energy sales information by the obligated subjects of the energy efficiency obligations system is determined, in accordance with the Royal Decree-law 8/2014, of the 4th of July, on approval of emergency measures for growth, competitiveness and efficiency.
The Royal Decree-law 8/2014, of the 4th of July establishes a system of obligations for the companies which commercialize gas and electricity, for the wholesale operators of petroleum products, and for the wholesale operators of liquefied petroleum gases, from the entry into force of the same.
Section 2 of the article 70 of the mentioned Royal Decree-law 8/2014, of the 4th of July, establishes that the obligated subjects must submit annually, before the 30th of September, to the Directorate General for Energy Policy and Mines, the data on the total national energy sales corresponding to the previous year, expressed in GWh.
The Directorate General for Energy Policy and Mines considered necessary to establish the procedure for compliance with this requirement:
- The submission of the information will be performed so that its record is passed to the Ministry of Industry, Energy and Tourism, before the 30th of September each year.
- The volumes of sales that will be taken into account for the calculation of quota will be the following:
a) Sales volume of electricity (GWh):
Sales volume of electricity to final consumers, excluding: Sales to other traders.
b) Sales volume of natural gas (GWh):
Sales volume of natural gas and liquefied natural gas in the domestic market to final consumers, excluding:
– Exports
– Sales to other gas traders
– Sales for electricity generation including cogeneration
c) Sales volume of petroleum products (GWh):
Sales volume of gasoline, diesel, kerosene and fuel oils in the domestic market, excluding:
– Exports
– Sales to the international maritime navigation
– Sales to other wholesale operators of the petroleum products
– Sales for electricity generation including cogeneration
d) Sales volume of LPG (GWh):
Sale volume of liquid petroleum gases in the domestic market, excluding:
– Exports
– Sales to other wholesale operators of the petroleum products
The conversion factors to be used for the submission of information will be the following:
a) For the conversion into the energy units.

b) For the conversion of the quantities in metric tons into the equivalent petroleum tones, expressed in equivalent petroleum ton/metric ton.

(*) If not known the actual density of the “gasoline blends” and the “biodiesel blends” it will be used the result of weighting of the densities of the amounts of each product in the mixture (conventional fuel and biofuel).
Before the 30th of September of 2014, both the subjects for which the Directorate General for Energy Policy and Mines established in the annex XII of the Royal Decree-law 8/2014 the financial contribution to be paid in 2014 to the National Energy Efficiency Fund, and the rest of the gas and electricity traders, wholesale operators of petroleum products and wholesale operators of liquid petroleum gases must submit the following information:
- Computable sales volume of energy in accordance with the Resolution of the 8th of September of 2014 of the Directorate General for Energy Policy and Mines, corresponding to the year 2012, expressed in GWh.
- Computable sales volume of energy in accordance with the Resolution of the 8th of September of 2014 of the Directorate General for Energy Policy and Mines, corresponding to the year 2013, expressed in GWh
Before the 15th of October 2014 obligated subjects for which the Directorate General for Energy Policy and Mines established in the annex XII of the Royal Decree-law 8/2014 their financial contribution to be paid in 2014 to the National Energy Efficiency Fund, will have to pay in cash.
