RECORDATORIO DE LAS OBLIGACIONES QUE A PARTIR DEL 4 DE MAYO DE 2014, TENDRÁN ANTE EL “SISTEMA DE INFORMACIÓN PARA LA CERTIFICACIÓN DE BIOCARBURANTES” (SICBIOS) LOS TRADERS, AGENTES INTERMEDIARIOS Y OPERADORES AL POR MAYOR QUE EXCLUSIVAMENTE VENDAN A OTROS OPERADORES AL POR MAYOR, SI ADQUIEREN BIODIÉSEL PROVENIENTE DE UNA PLANTA CON CANTIDAD ASIGNADA PARA SU POSTERIOR VENTA EN TERRITORIO ESPAÑOL.
Las obligaciones dimanantes de la publicación el pasado 4 de febrero, de la Resolución de 24 de enero de 2014, de la Secretaría de Estado de Energía, por la que se publica la lista definitiva de las plantas o unidades de producción de biodiésel con cantidad asignada para el cómputo de los objetivos obligatorios de biocarburantes, entran en vigor a partir del 4 de Mayo.
La Resolución además de aprobar la lista definitiva de las plantas o unidades de producción de biodiésel con cantidad asignada para el cómputo de los objetivos obligatorios de biocarburantes, establece que,
| A partir del día 4 de mayo de 2014 y durante el plazo de dos años prorrogables, únicamente el biodiésel producido en su totalidad en plantas con cantidad asignada, podrán ser objeto de certificación, sin perjuicio de las restantes condiciones reguladas en el artículo 7.3 de la Orden ITC/2877/2008, de 9 de octubre, por la que se establece un mecanismo de fomento del uso de biocarburantes. |
Esta circunstancia determina también que a partir del 4 de mayo de 2014, resulten de obligado cumplimiento los procedimientos, normas y reglas que la Circular 1/2013, de 9 de mayo, de la Comisión Nacional de Energía, por la que se regula la gestión del mecanismo de fomento del uso de biocarburantes y otros combustibles renovables con fines de transporte establece en relación con el biodiesel proveniente de una planta con cantidad asignada.
Por lo que respecta a los agentes integrados en la cadena de comercialización de biocarburantes que no son sujetos obligados, es decir los traders, operadores al por mayor que exclusivamente venden productos petrolíferos a otros operadores al por mayor o cualquier otro tipo de comercializador que adquieran biodiésel proveniente de una planta con cantidad asignada para su posterior “venta en territorio español”*, serán desde ese momento sujetos del “Sistema de Información para la Certificación de Biocarburantes” (SICBIOS).
* Se trata de una consideración general de “venta en territorio Español”, no resultará de aplicación la definición establecida en la Circular 1/2013, y se considerarán también “ventas en territorio español” las ventas a operadores petrolíferos.
Las obligaciones frente al “Sistema de Información para la Certificación de Biocarburantes” (SICBIOS), serán desde ese momento las siguientes:

Así mismo indicarles que si con anterioridad al 4 de mayo de 2014, han adquirido biodiesel proveniente de una planta con cantidad asignada, para su posterior venta en territorio español, deberán remitir a la CNMC una declaración responsable.
Plazo de presentación de la declaración responsable: Antes del 4 de junio de 2014. Contenido de la declaración: Volumen, a 4 de mayo de 2014, de existencias de biodiesel proveniente de una planta con cantidad asignada, desagregadas por partidas. Forma de presentación: Según model o que estará próximamente disponible en la aplicación SICBIOS, accesible a través de la página web de la CNMC. Suscriptor de la Declaración: Representante de la sociedad debidamente acreditado ante la CNMC. |

REMINDER OF THE OBLIGATIONS STARTING FROM THE 4TH OF MAY 2014 BEFORE THE “SYSTEM OF INFORMATION FOR THE CERTIFICATION OF BIOFUELS” (SICBIOS) IMPOSED ON THE TRADERS, INTERMEDIATE AGENTS AND THE WHOLESALE OPERATORS WHICH EXCLUSIVELY SELL TO OTHER WHOLESALE OPERATORS IF THEY ACQUIRE BIODIESEL COMING FROM THE PLANTS WITH ASSIGNED QUOTA FOR ITS SUBSEQUENT SALE WITHIN THE SPANISH TERRITORY.
We would like to remind you of the obligations arising from the publication on the 4th of February of the Resolution of the 24th of January 2014 of the State Secretariat of Energy by which it was published the definitive list of the plants or biodiesel production units with assignation for computing of the biofuel mandatory objectives.
Besides the approval of the definitive list of the plants and biofuel production units with the assigned quota for the computing of the biofuel mandatory objectives the Resolution establishes that:
| Starting from the 4th of May and during the period of two extendable years, only the biodiesel manufactured entirely in the plant with assignation may be certified, without prejudice to the rest of the provisions of the article 7.3 of the Order ITC/2877/2008 of the 9th of October by which the promotion mechanism of the use of the biofuels is established. |
This circumstance also means that starting from the 4th of May 2014 the procedures, norms and standards must be mandatorily complied with as stated in the Circular 1/2013 of the 9th of May of the National Commission of Energy, by which it is regulated the administration of the system of the promotion of the use of biofuels and other renewable
In relation to the agents integrated into the chain of the commercialization of the biofuels which are not the obligated subjects, thus meaning traders, wholesales operators which exclusively sell to other wholesale operators or any other type of the retailer which acquire biodiesel coming from the plant with assignation for its subsequent “sale within the Spanish territory”*, from this moment all they will be subjects of the “system for the Certification of the Biofuels” (SICBIOS).
*It is meant the general consideration of the “sale within the Spanish territory”, it will not be applicable the definition provided by the Circular 1/2013 and the sales to the wholesale operators will be also considered as “the sales within the Spanish territory”
The obligations before the “System of Information for the Certification of Biofuels” (SICBIOS), will be from this moment the following:

Also be advised that if prior to the 4th of May 2014 you had been acquired biodiesel coming from the plant with assignation for its subsequent sale in the Spanish territory, you must submit to CNMC the responsibility statement.
